These terms set the rules for using the site. Using the site is free of charge. By opening the site or sending a request, you accept these terms.
2. What you can do on the site
The site describes our services (advertising, websites, SEO, analytics and a lead system), shows our case studies and publishes guides. Free of charge, you can:
- browse the materials on the site;
- send a request through the form, including for a free audit;
- set your cookie consent.
These are services provided by electronic means, and these terms are their rules within the meaning of the Polish Act of 18 July 2002 on providing services by electronic means (ustawa o świadczeniu usług drogą elektroniczną). The agreement to browse the site is made when you open a page and ends when you close it. The agreement to use the form is made when you start filling it in and ends when the request is sent or the form is closed. You can stop using these services at any time.
3. Requests through the form
- A request is a request to contact you. It creates no contract and binds neither you nor us.
- We provide our services (advertising, websites, SEO, analytics, a lead system and others) only under a separate agreement. That agreement sets the scope of work, the price, the timeline and liability; these terms do not govern it.
- We may decline a project, for example if the task does not match our profile or the budget is below the minimum shown on the site.
- Give true information, and only information you have the right to share. Do not send special categories of data, such as information about health or religion.
How we process the data in your request is explained in our Privacy Policy.
4. The free audit
- The audit of your ads and analytics is a free information service, with no obligation for either side. We agree on its scope after your request.
The audit needs only read-only access to your ad accounts and analytics. We change nothing in them. You can remove the access at any time, including right after the audit.- We use what that access shows only for the audit.
- The result of the audit is a set of recommendations. You decide what to change and how, and whoever makes the changes is responsible for them. The audit does not guarantee any particular advertising results.
- We may decline to carry out an audit.
5. Rules of use
Use the site in line with the law and these terms. You may not:
- send unlawful or offensive content, or spam, through the site;
- pretend to be someone else or send other people’s data without the right to do so;
- try to gain unauthorized access to the site, the CRM or our other systems;
- disrupt the site: overload it with automated requests, spread malware, or get around the spam protection.
We may disregard requests sent in breach of these rules.
6. Intellectual property
The texts, guides, case descriptions, graphics, site design, logo and the Help Context name are protected by law, including copyright. Beyond what the law allows (for example, quoting with the source named), you may use them only with our prior consent.
The names and marks of Google, Meta, Facebook, Instagram, ChatGPT, TikTok, Telegram, Bing and other services belong to their owners. We mention them only to describe our services and are not official representatives of these companies unless we say so explicitly.
7. Information on the site
- We work to keep the information accurate and current, but ad platform rules, taxes and laws change. That is why we date the important facts in our guides.
- Our guides on running a business in Poland and other countries are general information, not legal, tax or accounting advice. Talk to a professional before you decide.
- Prices and service descriptions are not an offer within the meaning of the Polish Civil Code (Kodeks cywilny), only an invitation to enter into an agreement. The agreement sets the final terms.
- Results in our case studies refer to specific projects and periods. They show what we did, but do not guarantee the same result for another business.
8. Limitation of liability
To the extent the law allows, we are not liable for:
- the site being temporarily unavailable because of maintenance, provider outages or other circumstances beyond our control;
- decisions made solely on the basis of general information on the site;
- the consequences of using the site contrary to these terms;
- the content and policies of outside sites we link to.
These limits do not apply where the law does not allow them, in particular to damage caused intentionally and to consumer rights that cannot be limited.
9. Links to other sites
The site links to other sites: projects we show in our case studies, our social media profiles, and official sources in our guides. We do not control those sites; their own terms and privacy policies apply there.
10. Complaints about how the site works
If the site or the form does not work properly, write to
11. Privacy and cookies
How we process personal data is explained in our Privacy Policy, and which cookies the site uses, in our Cookie Policy. You can change your consent to analytics and advertising cookies at any time with the “Cookie settings” button at the bottom of the page.
12. Governing law and disputes
Polish law governs these terms and the use of the site. If a dispute arises, please write to us first, and let us try to resolve it by correspondence. Disputes are settled by the common court with jurisdiction over the registered office of TheBroda sp. z o.o. in Warsaw, unless mandatory consumer protection law provides otherwise. In particular, a consumer keeps the protection given by the mandatory law of the country where they live, and may bring a case before the courts of their place of residence where that law allows.
13. Changes to these terms
We may change these terms, in particular when the site, our services or the law change. A new version applies from the date shown at the top of the page. A request is governed by the version in force when it was sent.
14. Language
The Polish version of these terms is binding: Regulamin. The Ukrainian and English versions are translations for convenience; if they differ, the Polish text prevails.
